American Mortgage Consultants, Inc. ("AMC") - Privacy Policy

The website located at https://www.amcfirst.com (the “Website”) is operated by American Mortgage Consultants, Inc. (“AMC”) and certain products and services provided on or in connection with the Website are provided by AMC or its subsidiaries. This privacy policy (“Privacy Policy”) describes the ways that AMC uses and protects information collected by or provided to AMC. All such information collected by or provided to AMC in connection with the use of the Website is subject to this Privacy Policy. An individual or entity accessing the Website or the information contained therein (a “User”) must read, understand and agree to the Terms of Use for the Website and the terms of this Privacy Policy.

Information Collected by AMC. AMC collects various types of information from Users of the Website and in the course of providing products and services. This information includes, but is not necessarily limited to, contact information, billing information, technical information relevant to the Website or a product or service provided by AMC, whether such information is related to such User of the Website, AMC clients or customers or consumers of AMC’s clients (including Personal Information, as defined herein). Information may be provided directly by a User or potential User of the Website or AMC’s products or services, collected when an individual accesses or submits information to the Website, or is obtained by AMC from third parties in the course of operating the Website or delivering products and services.

In addition, when a User visits the Website, AMC may collect and store information about the visit. This information may include, but is not limited to, the time and length of the visit, the pages viewed on the Website, actions taken while on the Website, and other information that may be relevant to a User’s actual use of the Website along the purpose of such application. AMC also may collect, on an anonymized and aggregate basis, the website the User visited just before coming to the Website and the name of a User’s internet service provider. AMC uses this information to measure Website activity and to develop ideas for improving the Website.

Types of Information:

  • Confidential Information: non-public information concerning an individual or entity. Confidential information includes Personal Information.
  • Personal Information: a subset of Confidential Information, Personal Information includes any data this is personally identifiable, such as name, social security number, street address, account numbers, phone numbers, and financial information. Personal Information does not include information that does not identify a specific individual.

Use of Information:
Information collected by AMC may be used in the following ways:

  • To operate the Website.
  • To provide technology in-line with its stated purpose of use for a client and other Users.
  • To provide products and services provided by AMC.
  • To provide customer service with respect to the Website or products or services provided by AMC.
  • To improve the Website or products or services provided by AMC.
  • To address any network security issues.
  • In connection with the prevention, investigation, or resolution of illegal activities, violation of AMC’s Terms of Use, or contractual obligations of AMC clients or vendors.

Security of Confidential Information. AMC protects Confidential Information with physical, administrative, and technical safeguards that address the integrity and security of Confidential Information in AMC’s possession. All Personal information that is transmitted to or from AMC is transmitted using secure transmission methods and/or up to 256 bit encryption. All Personal Information stored by AMC is encrypted before storage and all data at rest is encrypted. AMC contractually requires its website Users to represent and warranty that they have physical, administrative and technical safeguards in place to protect Confidential Information.

Sharing of Confidential Information. AMC limits the sharing of Confidential Information. Confidential Information will be shared with employees, contractors or agents of AMC in connection with the operation of the Website or the provision of products or services or in connection with such any such individuals’ performance of their job responsibilities (such as legal or finance personnel). Information may also be shared with other Users of the Website.

AMC requires all employees, contractors and agents that may have access to Confidential Information to be legally bound by obligations to protect the confidentiality of such information in accordance with the terms of this Privacy Policy and applicable law. AMC requires all Users of the Website to certify that they have met certain eligibility restrictions and to agree to the confidentiality obligations in its Terms of Use.

Any transfer of Personal Information to a third party will be in connection with the business purpose for which AMC received such Personal Information or as required or permitted by applicable law.

AMC does not transfer, sell or disclose any Confidential Information to anyone for any reason without the applicable person’s prior consent, and does not use any Personal Information for any marketing purposes (including by any affiliates of AMC). AMC contractually requires all User of the Website to agree to such restrictions in its Terms of Use.

AMC may disclose Confidential Information (1) as may be required by law, including without limitation, pursuant to a subpoena, search warrant or other court order or to the order of any regulatory body having jurisdiction over AMC or its affiliates, or (2) as necessary to enforce these Terms of Use.

Data Retention. AMC hereby informs User, and User is aware, that AMC believes that the materials being shared and utilized through the Website may fall under document retention requirements applicable for rated securitization transactions. As such, all commentary history and other relevant information may be retained by AMC in order to fulfil its obligations under such applicable regulations or laws. User agrees and acknowledges that this Privacy Policy is being provided as an agreement applicable for the provision of technology services and not for the provision of “due diligence services” as defined in 17 CFR 240.17g-10(d)(1) despite the utilization of the Website by parties for purposes that may fall under such regulation. User further agrees and acknowledges that any responsibilities of AMC to provide documentation related to 17 CFR 240.17g-10(d)(1), including those specified under Form ABS Due Diligence-15E, that complies with the requirements of Section 15E(s)(4)(B) of the Securities Exchange Act of 1934, as amended (the “Exchange Act”) and Rule 17g-10 thereunder (17 CFR 240.17g-10) will be provided as may be separately contracted for by a User with such contracting permission.

Cookies. AMC uses cookies to measure Website activity and to customize information for Users based on their permissions within the site. A cookie is data that a website can send to a User’s browser, and the browser may then store the cookie on the User’s hard drive. If a cookie is stored on a User’s hard drive, when the User comes back to visit the Website again, AMC can tailor information to suit the User’s individual preferences or permissions. Passwords are never stored through cookies. The goal of using cookies is to save the User time and provide the User with a more meaningful visit to the Website.

Changes to Privacy Policy. From time to time, AMC may make changes to this Privacy Policy. When changes are made, AMC will revise the “last updated” date at the beginning of this Privacy Policy. Continued use of the Website or any of AMC’s products or services constitutes acceptance of the current version of this Privacy Policy. AMC encourages Users to revisit this Privacy Policy on occasion to learn of any changes.
